By accessing or using https://powmcp.com (the "Website"), you agree to these Terms of Service (the "Terms") and acknowledge our Privacy Policy. If you do not agree, do not use the Website.

1) Definitions

For purposes of these Terms:

• "Content" means text, images, graphics, audio, video, code, and other materials made available on the Website.
• "User" / "you" means any person who accesses or uses the Website.
• "We" / "us" / "our" means Frostwave Labs Inc.
• "Third-party services" means services and sites not owned or controlled by us, including linked sites and providers used for enabled Website features.

2) Who we are

The Website is owned and operated by Frostwave Labs Inc.

The Website may also use the brand or site name PowMCP. Our mailing address is 2967 Dundas St. W. #992, Toronto, ON M6P 1Z2.

3) Eligibility

You must be at least 13 years old, or the age of majority in your jurisdiction if higher, to use the Website. By using the Website, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4) Website content

Content on this Website is provided for general informational, entertainment, marketing, and educational purposes only and is not professional advice, including legal, medical, financial, tax, or other regulated advice. You should not rely on any Content as a substitute for professional advice tailored to your situation.

We do not represent or warrant that any Content is current, complete, or error-free, and we may change or remove Content at any time.

Some Content may be generated or assisted by automated systems, including artificial intelligence, and may contain errors or omissions. You agree to independently verify any Content before relying on it.

We do not guarantee any specific outcomes or results from your use of the Website or Content.

5) Intellectual property

Unless otherwise stated, we own or license the content on the Website, including text, graphics, logos, and design.

You may view and print content for personal, non-commercial use. You may not reproduce, distribute, sell, or create derivative works from our content without permission.

6) Copyright infringement

We respect the intellectual property rights of others. If you believe material located on or linked to by the Website violates your copyright, contact us at support@powmcp.com with:

• Your physical or electronic signature
• Identification of the copyrighted work
• Identification of the material you believe is infringing
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information is accurate and that you are the copyright owner or authorized to act on their behalf

We will respond as required or appropriate, including by removing the infringing material or disabling links to it.

7) Acceptable use

You agree not to:

• Use the Website in any unlawful way
• Attempt to disrupt or damage the Website, including scraping at abusive rates, probing, DDoS, malware, or similar activity
• Circumvent security or access restricted areas
• Use automated means to access the Website in a manner that imposes an unreasonable load or bypasses access controls, unless you have our express written permission
• Reverse engineer, decompile, or attempt to extract source code except to the extent such restriction is prohibited by law
• Remove, obscure, or alter proprietary notices

This does not apply to generally accepted search engine crawling or indexing. We may suspend or block access if we reasonably believe you are misusing the Website.

8) Third-party links and services

The Website may link to or use third-party websites and services. We do not control them and are not responsible for their content, policies, practices, availability, or security. Your use of third-party sites and services is at your own risk.

Third-party services may have their own terms and privacy practices. You are responsible for reviewing and complying with those terms.

9) Newsletter and email communications

Newsletter subscriptions and related email communications are governed by our Privacy Policy and by any subscription, unsubscribe, or preference controls provided with those communications.

10) App and MCP tool use

The apps perform narrow validation and measurement jobs using the scope described on each app page. Results report what the selected engine observed and are not a guarantee that the submitted material is complete, safe, lawful, accessible, or suitable for a particular purpose.

You must have the right to submit each URL, file, or other input and must not use the service to probe private networks, bypass access controls, disrupt systems, or process unlawful material. Do not submit identifiable patient records, directly identifying genetic information, payment-card or bank credentials, government identifiers, authentication secrets, or other sensitive personal information. The health, financial-reporting, government-data, security, and related apps validate technical formats and public configuration only; they do not provide diagnosis, treatment, legal, tax, financial, filing, certification, or other regulated professional services.

Usage limits apply across the Website and connected MCP clients and may be enforced by account, browser guest, platform-provided, or guest network identity. Guest includes 50 app requests for the lifetime of the available guest identity, which may be a persisted browser identifier, a platform-provided identifier, or a normalized network bucket. Free includes 100 app requests each calendar month.

11) Paid plans, request packs, cancellation, and refunds

Paid checkout is available under the following terms.

Dodo Payments is our non-exclusive reseller and Merchant of Record for paid purchases. Buyers purchase paid plans and request packs from Dodo Payments under the buyer terms shown at hosted checkout. Dodo Payments processes the transaction, issues tax invoices, collects and remits applicable sales taxes, and handles approved refunds. PowMCP supplies and supports the service.

The Pro plan includes 500 app requests per monthly subscription period for USD $19/month, 5x the Free allowance. The Scale plan includes 2,000 app requests per monthly subscription period for USD $49/month, 20x the Free allowance. Each completed result counts as one app request regardless of the app used. Each account may use one 30-day paid-plan trial total across Pro and Scale. A payment method is required, and the trial begins only after you deliberately choose a paid plan and complete hosted checkout. Creating or using a Guest or Free account does not start a paid trial. Switching between Pro and Scale is unavailable while a trial is active. The trial keeps its original end date, and you may choose another plan after it ends.

At the end of the trial, the selected subscription will renew for the monthly price shown at checkout unless canceled first. Paid subscriptions then renew monthly until canceled. A plan change uses a new hosted confirmation that shows the price and effective timing before it is submitted. You may request cancellation at any time through the customer portal or by emailing support@powmcp.com. Cancellation stops the next renewal and access continues through the end of the current paid period.

Request packs are one-time purchases of 200 app requests for USD $10 or 600 app requests for USD $25 and do not renew. Purchased requests have no cash value, are not transferable, remain available until used, and are consumed only after the included plan allowance.

To request a refund, email support@powmcp.com within 14 calendar days of the charge with the account email, transaction or invoice reference, and reason. Refunds are available for duplicate charges, non-delivery, a material service defect or material difference from the description, and whenever required by applicable law. Used request packs, consumed subscription periods, misuse, and change-of-mind requests are not automatically refundable where the law permits.

We will review the request and coordinate any approved full or partial refund with Dodo Payments, our non-exclusive reseller and Merchant of Record. Approved refunds return to the original payment method; bank processing time may vary. Dodo Payments' buyer terms shown at checkout also apply, and mandatory consumer rights always prevail.

12) User content

The Website does not currently accept public user-submitted content, such as comments. If this changes, we may update these Terms.

13) Disclaimer of warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Any reliance on the Website or Content is at your own risk.

14) Limitation of liability

To the maximum extent permitted by law, Frostwave Labs Inc. will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of, or inability to use, the Website.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any liability or remedy preserved by mandatory consumer law. If liability cannot be excluded, it will be limited only to the extent permitted by applicable law.

15) Indemnity

You agree to indemnify and hold harmless Frostwave Labs Inc. from claims, damages, liabilities, and expenses arising out of your misuse of the Website or violation of these Terms.

This includes claims arising from:

• Your violation of any applicable law or regulation
• Your infringement or alleged infringement of any third-party rights
• Your use of third-party products or services linked from the Website

16) Changes to the Website or Terms

We may change or discontinue the Website at any time. We may update these Terms by posting an updated version with a new effective date. Changes apply prospectively from that date. Where applicable law requires notice or consent, we will provide it.

17) Termination

We reserve the right, without notice and in our sole discretion, to terminate your right to use the Website, and to block or prevent your future access to and use of the Website, if you violate these Terms or for any lawful reason.

All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18) Governing law and consumer rights

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules.

This choice of law does not deprive you of mandatory consumer protections that apply where you live.

19) Dispute resolution

Before filing a claim, you agree to contact us at support@powmcp.com and make a reasonable attempt to resolve the dispute informally. This does not prevent either party from seeking urgent relief or using a court, tribunal, regulator, consumer-protection body, or dispute process available under applicable law.

20) Severability; waiver; assignment

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

21) Entire agreement

These Terms constitute the entire agreement between you and us regarding the Website and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.

No third-party beneficiaries: These Terms are for the benefit of you and us only and do not create third-party beneficiary rights.

Headings and interpretation: Section headings are for convenience only and do not affect interpretation. The word "including" means "including without limitation".

22) Force majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, transportation shortages, fuel shortages, energy shortages, labor shortages, or material shortages.
